Terms and Conditions of Sale

1. Preamble

These Terms and Conditions of Sale (hereinafter the "Terms") govern the relationship between, on the one hand, Swan Skora, publisher of the website https://lootingzone.com/ (hereinafter "LootingZone" or the "Website"), and, on the other hand, any individual purchasing products through the Website (hereinafter the "Customer"), who wishes to purchase the products offered for sale (hereinafter the "Products").

The Customer is any adult individual (or any person with the legal capacity to enter into contracts) purchasing Products through the Website for personal, non-commercial purposes.

For the purposes of these Terms, LootingZone and the Customer shall collectively be referred to as the "Parties" and individually as a "Party."

In accordance with Article L.223-1 of the French Consumer Code, if you do not wish to receive telephone marketing calls, you may register your number on the French Bloctel opt-out list at www.bloctel.gouv.fr.

2. General Provisions

The Website has been created by LootingZone, which owns all intellectual property rights relating to it.

Any copying, downloading, or reproduction, in whole or in part, of the Website or its content is strictly prohibited without prior written authorization.

Each Product offered for sale includes a description of its essential characteristics in accordance with Article L.111-1 of the French Consumer Code.

By placing an order (the "Order"), the Customer fully and unconditionally accepts these Terms.

The Customer acknowledges having the legal capacity to enter into this agreement and being aware of the regulations applicable to the use of the Products, particularly under French law.

The applicable Terms are those in force on the date the Order is placed and remain effective for the entire period necessary to supply the Products.

For Orders delivered outside mainland France, the Customer is responsible for checking any import or usage restrictions with local authorities.

LootingZone shall not be held liable if a Product complies with French law but is prohibited under the laws of the Customer's country.

3. Prices

Product prices are displayed in euros (€), inclusive of all applicable taxes (VAT included), but excluding shipping, packaging, and handling fees.

These additional costs are displayed before the Order is finalized.

The total amount payable appears in the Order summary, which the Customer may review before confirming the purchase.

Prices displayed in other currencies are provided for informational purposes only.

LootingZone reserves the right to modify its prices at any time. Products are invoiced based on the prices in effect at the time the Order is confirmed.

Payment is due immediately, in full, and in a single transaction upon placing the Order through a secure payment system.

LootingZone may offer third-party payment solutions over which it has no control. Their use is the sole responsibility of the Customer.

4. Orders and Acceptance

Before placing an Order, the Customer acknowledges having received these Terms and all mandatory pre-contractual information required under Articles L.111-1 to L.111-8 of the French Consumer Code, including:

  • the essential characteristics of the Product;
  • the price and any additional fees;
  • the delivery date or estimated delivery period;
  • LootingZone's identity and contact details;
  • applicable legal warranties and how they apply;
  • the possibility of consumer mediation in the event of a dispute;
  • the right of withdrawal.

The Customer may browse the Website freely without obligation.

However, certain Products may become unavailable before an Order is completed.

Ordering Process:

  1. Add Products to the shopping cart ("Add to Cart").
  2. Access the cart and click "Checkout."
  3. Enter personal information or log into an existing customer account.
  4. Accept these Terms (checkbox).
  5. Select the shipping address and delivery method.
  6. Complete payment.

LootingZone reserves the right to suspend or close a customer account in the event of a breach of these Terms, following prior notice.

An Order is considered accepted by LootingZone upon receipt of payment within a maximum period of five (5) days.

An Order confirmation (or a reasoned refusal) will be sent within forty-eight (48) business hours after payment is received.

5. Shipping and Delivery

Products are shipped from China through third-party logistics providers.

Shipping costs are calculated automatically based on the delivery destination, package weight, and selected shipping method.

Estimated delivery times for France range from 5 to 15 business days and are provided for guidance only.

LootingZone will inform the Customer of any foreseeable delays.

If delivery is not completed within the agreed timeframe (or within thirty (30) days where no specific timeframe has been agreed), the Customer may cancel the sale after giving formal notice that remains unsuccessful, and will receive a refund within fourteen (14) days.

Any additional costs resulting from an incorrect delivery address or failed delivery shall be borne by the Customer.

Ownership of and risk relating to the Products pass to the Customer upon physical receipt of the Products.

Customs duties, import taxes, or other local charges may apply depending on the destination country and remain the Customer's responsibility.

6. Payment

Payments are processed online using the available payment methods, including Visa, MasterCard, American Express, UnionPay, PayPal, Apple Pay, and other supported services.

Payment must be made in full when the Order is placed.

In the event of non-payment, incorrect address details, or issues relating to the Customer's account, LootingZone reserves the right to suspend the Order until the issue has been resolved.

Any fraudulent use of a payment method must be reported immediately to contact@lootingzone.com.

Invoices are archived on a secure and durable medium for ten (10) years in accordance with Article L.213-1 of the French Consumer Code.

7. Right of Withdrawal / Returns

In accordance with Article L.221-18 of the French Consumer Code, the Customer has fourteen (14) days from receipt of the Product to exercise the statutory right of withdrawal.

The Customer must notify LootingZone of this decision by sending a clear statement by email or post to contact@lootingzone.com.

The refund includes the purchase price and standard delivery costs and will be issued within fourteen (14) days using the same payment method originally used.

Products must be returned within fourteen (14) days in good condition and, where possible, in their original packaging.

Return shipping costs are covered by LootingZone unless otherwise specified.

8. Warranties and Liability

The Products sold comply with applicable French regulations.

Product photographs are provided for illustrative purposes only and are not contractually binding.

Products benefit from:

  • the French legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code); and
  • the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Consumers have two (2) years from delivery to invoke the legal guarantee of conformity.

Where a Product is defective, the Customer may request repair, replacement, or reimbursement in accordance with applicable law.

9. Intellectual Property

All elements of the Website, including texts, images, audio, videos, trademarks, logos, software, and other materials, are protected by applicable intellectual property laws.

Any reproduction or use without LootingZone's prior written authorization is strictly prohibited.

The Customer grants LootingZone, free of charge, the right to reproduce, publish, and distribute any content submitted to the Website, including reviews, suggestions, or other user-generated content.

10. Personal Data

When Customers browse the Website, create an account, or place an Order, LootingZone acts as the data controller for the processing of personal data.

For more information regarding the collection and processing of personal data, please refer to the Privacy Policy available on the Website.

11. Force Majeure

Any event beyond the reasonable control of the Parties that prevents the normal performance of their contractual obligations shall constitute a force majeure event, suspending the affected obligations.

If such event continues for more than three (3) months, either Party may terminate these Terms.

12. Governing Law and Jurisdiction

These Terms are drafted in French and governed exclusively by the laws of France, regardless of the Customer's country of residence.

Any dispute shall fall within the exclusive jurisdiction of the French courts.

In accordance with Article R.631-3 of the French Consumer Code, the Customer may bring proceedings before:

  • the court having jurisdiction over the Customer's place of residence; or
  • the court having jurisdiction over the place where the contract was concluded.

If a dispute cannot be resolved amicably, the Customer may refer the matter, free of charge, to an approved consumer mediation service within one (1) year following a written complaint that has remained unanswered or has not received a satisfactory response within two (2) months.
